Ordinance Regarding the Obstruction of Class V Roads in New Durham TO.03.003

The following Ordinance has been enacted by the Selectmen of New Durham, N.H. pursuant to the powers granted them in RSA 41:11 and RSA 47: 17 (VII) amends all others.

1.  Snow Obstruction:

No person shall deposit, or cause to be deposited, any ice or snow, which has been removed from private property, in or upon any street, road, or public place in the Town.

2.  Parking:

No Person having custody or control of any vehicle, trailer, or semi trailer shall park or cause any vehicle trailer or semi trailer to be parked on the street of New Durham or in the right of way

3.  Exceptions:

Delivery vehicles –This shall include but not limited to mail type vehicles, oil, gas, electric, telephone, cable, moving trucks and other vehicles making home deliveries.

4.  Penalty:

Any Person found in violation of the (1) snow obstruction, shall be issued a civil forfeiture in amount of $100.00 for the first offense and for each successive offense a civil forfeiture of $250.00. Any one found in violation of (2) parking, will be issued a civil forfeiture in the amount of $25.00 for the first offenses, $50.00 for a second offense and $100.00 for each successive offense. This will be paid to the Town of New Durham at the Town Clerks Office within 15 days of issuance. Failure to comply with this procedure will result in a summons to the Rochester District Court.

EFFECTIVE DATE: This Ordinance shall become effective May 1, 2003
